The newest no-fault divorce procedure is set to end the ‘divorce blame game’ when it comes into legal effect in England and Wales on 6th April 2022. This change allows a joint application and a bid to encourage spouses to work together to bring an amicable end to their relationship.

If you would like to submit a divorce application under the current divorce procedure, you can do so before 31st March 2022. Please note, the digital service will be closed to new applications between March 31st 2022, to 5th April 2022, in preparation of the new system.

Other divorce changes
No longer be possible to contest a divorce
Under current law, one party submits a divorce petition citing their grounds for divorce. However, their spouse can contest these grounds for divorce. Under the new no-fault system, this will no longer be an option.
Therefore, this removes the argumentative basis of many divorce cases. Leading to the biggest change to UK divorce law in 50 years.
Both spouses agreeing to the decision to divorce
Although the opposing party will not be able to contest the grounds for divorce, the no-fault divorce procedure continues to offer the opposing spouse the option to contest the divorce in the way they would in a traditional divorce. If this was to happen, the case would be put before a judge.
