Is the divorce blame game over?

The newest no-fault divorce procedure is set to end the ‘divorce blame game’ when it comes into legal effect in England and Wales on 6th April 2022. This change allows a joint application and a bid to encourage spouses to work together to bring an amicable end to their relationship.

You can find more information on our website where it sets out the differences between the current divorce procedure and the upcoming no-fault divorce procedure. No-Fault Divorce. What Does This Mean? – Bond Adams Solicitors LLP.

Other divorce changes

No longer be possible to contest a divorce

Under current law, one party submits a divorce petition citing their grounds for divorce. However, their spouse can contest these grounds for divorce. Under the new no-fault system, this will no longer be an option.

Therefore, this removes the argumentative basis of many divorce cases. Leading to the biggest change to UK divorce law in 50 years.

Both spouses agreeing to the decision to divorce

Although the opposing party will not be able to contest the grounds for divorce, the no-fault divorce procedure continues to offer the opposing spouse the option to contest the divorce in the way they would in a traditional divorce. If this was to happen, the case would be put before a judge.

Positive impact on making child arrangements

Removing the blame from the divorce procedure may help both parties avoid unnecessary conflict and move their focus away from the past to plan on how they can move forward. This can also create a positive influence on making mutual decision on their children’s welfare and future arrangements.
